An energy certificate is also required for the sale and rental of flats
Perhaps it is already well known that in Hungary it is necessary to obtain an energy certificate for the classification of the energy characteristics of the real property when you purchase or lease an apartment pursuant to Government Decree of 176/2008 (VI. 30.).
The certificate is prepared using a program developed by the Minister of Construction, receives a unique certificate identification code and is automatically entered in the National Register of Construction. Engineers with energy certification privileges are eligible to issue the energy certificate.

But not only in case of buying a home when this certificate is mandatory. It should be emphasized that in case of transfer (sale) or lease of real estate for consideration, it is absolutely necessary, but according to the government decree, the construction of a new building, 250 m2 or more useful state-owned public buildings is mandatory.
However, it is not necessary to obtain an energy certificate for a stand-alone building with a useful floor area of less than 50 m2 that is not connected to another building; a building used for housing and recreation intended for use for less than 4 months of the year (for example: a holiday home); for a parade building, foil or tent structure intended for use for up to 2 years; building used for credit purposes (churches); for a low-energy non-residential agricultural building where the air temperature during the operation of the heating system does not exceed 12 ° C or is heated for less than 4 months and cooled for less than 2 months; to the workshop or building in the industrial area, if the internal heat gain from the technology during the intended use is more than 20 W / m2, or more than twenty times air exchange is required or occurs during the heating season.
In addition, according to the decree, it is not necessary to request an energy certificate in the case of a transfer of ownership prior to the commissioning permit (notification); if an owner who has a share in the same property acquires an additional share for consideration (sale between co-owners); or in relation to natural persons who are unable to fulfill their obligations under the credit agreement in the event of a change of ownership and lease.
The written contract for the transfer or lease of the real estate must include a statement as to whether a certificate must be drawn up and, if so, the unique identification code of the certificate and the buyer's or tenant's declaration that the identification code received a certificate or a copy thereof from the seller or lessor.
